January 2012

Mobile phone operators appear to be commencing phase 2 of their rent reduction programs. They are targeting landlords who have already agreed to a previous rent reduction on the promise this would benefit them in the future. This is not the case! Before you agree to any reduction in your phone mast rental you should seek professional advice on whether agreeing to a mobile network operators demands will actual improve the future security of your phone mast income and prevent future attempts to reduce your mast rent. Otherwise you could become an easy target for constant rent reductions or threats of losing your mast income.

Most network operators are now more profitable than they have ever been and agents acting for them often work on a no win - no fees basis. If they do not agree a reduction in your rent they do not get a fee! Remember, reducing mast site rentals is not helping prevent operators from going into liquidation (as they may lead you to believe) it is purely an exercise to increase their profit. You only need to look at the profits these firms are generating on Companies House. A 4G network is imminent and the chances are, most mobile phone operators will need more masts not less, as seen with the roll-outs of 2G and 3G networks. Ofcom have just announced the auction of 4G licenses. 4G networks will greatly benefit mobile phone users with smart phones as the data download speeds will be greatly improved. The auction will start in the first quarter of 2012, subject to consultation. The operators are expected to start rolling out the 4G networks and mobile masts in 2013. As seen with the 3G network rollout, we expect the 4G networks will require additional mobile base stations. This will mean many phone operators will have to upgrade sites and increase their number of mobile phone masts.

All the operators are now involved in rent reduction attempts. Orange and T-Mobile (Everything Everywhere Ltd) Vodafone, O2, H3G and Airwave are all trying to persuade landlords to accept lower rents. Our advice remains the same, no matter which operator you are dealing with, send us a copy of your lease which we will review free of charge and provide you with our professional opinion. Each site needs to be assessed on its own merits. Some are very unlikely to be removed from the network, others are more at risk. Orange and T Mobile merge to form Everything Everywhere. This is due to take effect on the 1st July 2010. Over the past few months most of the mobile phone mast operators and operators agents have been claiming that market rents for mobile phone mast sites have fallen. The Phone Mast Company does not agree and is still agreeing rental increases on many of our deals. We have yet to see any significant evidence to show falling rents. Many mobile phone operators are taking an aggressive approach with Landlords. They are unable to provide any real evidence of falling rents and are simply threatening Landlords that unless they accept a rent reduction, they could lose their mast / income. In many cases mobile phone operators are refusing to renew existing leases, instead opting to "hold over" on the same lease terms / rents as the previous leases.

At present many of the mobile phone mast operators are claiming that market rents for mobile phone mast sites have fallen. This is not the case and is only what the mobile phone mast companies want you to believe to help reduce their running costs.
